Terms of Service
These Terms govern access to and use of PresaleIQ (the "Service"), provided by PresaleIQ, Elgin, Illinois, USA ("PresaleIQ", "we"). By creating an account or using the Service on behalf of an organisation ("Customer"), you agree to these Terms for that organisation and confirm you have authority to do so. A signed order form or enterprise agreement takes precedence over these Terms where they conflict.
1. The Service
PresaleIQ analyses discovery-call content and generates pre-sales deliverables (such as user stories, statements of work, estimates, designs and licence sizing), and can push approved items to platforms Customer connects. Features vary by plan.
2. Accounts
Customer is responsible for its users, for keeping credentials confidential, and for all activity under its account. Free trials are limited to one per organisation and may be ended if abused.
3. Customer Content and ownership
- Customer retains all rights to the content it submits and owns the outputs the Service generates for it.
- Customer grants PresaleIQ a limited licence to process that content solely to provide, secure and support the Service, as described in our Privacy Policy.
- Customer is responsible for having the right to submit its content, including any notices or consents needed to record or transcribe meetings with third parties.
- PresaleIQ owns the Service, its software, prompts, templates and trademarks. Feedback may be used without obligation.
4. AI-generated output
Outputs are produced by artificial intelligence (including Anthropic's Claude) and may be inaccurate or incomplete. Customer must review outputs with qualified personnel before relying on them, sending them to clients, or pushing them to production systems.
5. Acceptable use
Customer will not: (a) use the Service unlawfully or to infringe others' rights; (b) attempt to access other customers' data, probe or disrupt the Service, or bypass usage limits; (c) reverse engineer the Service or use it to build a competing product or train AI models; (d) resell the Service except as agreed in writing; or (e) use the Service in violation of Anthropic's Usage Policy, which applies to all AI features.
6. Third-party platforms
Connections to ServiceNow, Jira, Salesforce and other platforms are made with credentials Customer provides and are subject to those platforms' own terms. Platform names are trademarks of their owners; PresaleIQ is not affiliated with or endorsed by them.
7. Fees
Paid plans are billed in advance through PayPal on a recurring basis until cancelled. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice before the next renewal.
8. Term and termination
Either party may terminate at any time; Customer by cancelling its subscription, and PresaleIQ with 30 days' notice, or immediately for material breach or misuse. On request within 30 days of termination we will make Customer's retained content available for export, after which it will be deleted.
9. Warranties and disclaimer
We will provide the Service with reasonable skill and care. EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, CONSEQUENTIAL OR LOST-PROFIT DAMAGES, AND EACH PARTY'S TOTAL LIABILITY IS LIMITED TO THE FEES PAID BY CUSTOMER IN THE 12 MONTHS BEFORE THE CLAIM.
11. General
These Terms are governed by the laws of the State of Illinois, USA, with exclusive jurisdiction in the state and federal courts located in Cook County, Illinois. PresaleIQ may assign these Terms in connection with a merger, acquisition or sale of all or substantially all of its assets. Contact: support@presaleiq.ai.
